Background Bennett Environmental Inc. has over 30 years experience in the environmental industry and has provided high temperature remedial soil treatment solutions to contaminated sites in Canada and the United States. The company has developed a technology, referred to as the Thermal Oxidizer process in which contaminated soils are treated at extremely high temperatures to separate, remove and destroy the contaminants. Bennett is proposing to operate its technology in a facility to be built at 233 Archer Drive in the Town of Kirkland Lake, Ontario. Bennett volunteered on May 10th, 2000 to subject its proposed Kirkland Lake facility to review under the Environmental Assessment Act. Bennett first prepared the draft Terms of Reference. The purpose of the ToR is to set out the required content of the Environmental Assessment (EA) and the public consultation process to be followed for the preparation of the EA. The comment period for the draft ToR was June 23rd to July 28th, 2000. Based on feed back that we received, the proposed Terms of Reference was finalized and submitted to the Minister of the Environment for approval on November 15, 2000. The comment period for the proposed ToR was November 20th to December 19th, 2000. The ToR was amended to incorporate comments received from the MOE, the public and government review agencies. Further submissions were invited by the MOE until February 23, 2001. The amended Terms of Reference was Approved with further amendments by the Minister of the Environment on March 30, 2001. The document will now be referred to as the Approved Terms of Reference. The Approved Terms of Reference is available at all Offices of Public Record.
